Alternative Dispute Resolution Mechanisms
SILVIP ensures that its investors have access to Alternative Dispute Resolution (ADR) mechanisms whenever a claim previously submitted to SILVIP and the Portuguese Securities Market Commission (CMVM) has not been fully addressed.
In such cases, the investor (in the capacity of a non-professional investor) may resort to the following alternative dispute resolution entities, for disputes not exceeding €30,000 (thirty thousand euros):
- Lisbon Consumer Conflict Arbitration Centre – CACCL
- Consumer Conflict Arbitration Centre of the Coimbra Region – CACRC – Início
- Consumer Conflict Arbitration Centre of Ave, Tâmega and Sousa – TRIAVE – Centro de Conflitos de Consumo do Vale do Ave/Tribunal Arbitral
- Consumer Information and Arbitration Centre of Porto – CICAP – Tribunal Arbitral do Consumo
- Consumer Information, Mediation and Arbitration Centre (Consumer Arbitration Tribunal) – CIAB – O CIAB é um Centro de Arbitragem de Conflitos de Consumo, que promove a realização de arbitragem de forma institucionalizada.
- Consumer Information, Mediation and Arbitration Centre of the Algarve (CIMAAL) – Centro de Arbitragem de Conflitos de Consumo do Algarve – Início
- National Consumer Conflict Information and Arbitration Centre (CNIACC) – CNIACC – Centro Nacional de Informação e Arbitragem de Conflitos de Consumo
For more information on alternative dispute resolution mechanisms applicable to the management of collective investment undertakings or related and ancillary activities, please visit the CMVM website at investidor.cmvm.pt/PInvestidor and the Consumer Portal at consumidor.gov.pt.
Filing a complaint with SILVIP or supervisory authorities does not affect the investor’s right to resort to ADR mechanisms or competent judicial remedies.
